Order for Protection (OFP)

An Order for Protection (OFP) serves to protect individuals facing domestic abuse. If you have experienced domestic abuse and the perpetrator is a family or household member, you are eligible to apply for an OFP. 

In Minnesota, domestic abuse encompasses actions such as:

  • Causing physical harm
  • Making terroristic threats
  • Engaging in criminal sexual behavior with an adult
  • Engaging in any sexual contact with a minor
  • Obstructing a 911 emergency call.

An OFP can be issued immediately on an emergency basis (ex parte) or after a judicial hearing. If your application for an OFP is initially refused or approved without a hearing, both you and the opposing party have the right to request a formal hearing. The OFP can cover various forms of protection and orders, including but not limited to, the allocation of property, determining custody and visitation rights, child support, and alimony. Some of these orders may necessitate a hearing before they are approved.

Harassment Restraining Orders

In Minnesota, harassment is characterized by any of the following actions:

  • A single occurrence of physical or sexual assault.
  • One incident of stalking.
  • One instance of sharing private sexual images without consent.
  • Multiple actions that are intrusive or unwanted, including verbal or physical behaviors, intended to significantly impact another's safety, security, or privacy negatively.

The relief available through a Harassment Restraining Order (HRO) is limited to prohibiting the harasser from contacting the victim or engaging in further harassment. A judge can either grant or deny an HRO without holding a hearing. However, both the applicant and the person against whom the HRO is sought have the right to request a hearing within a designated timeframe to contest or argue the decision.
